1. Scope of application
The website Waste-to-Energy Research Technology Germany - WtERT (www.wtert.eu) provides its services based on the terms of use stated here forth. The Terms of Use provided online at the time of using the services of this site shall be applicable. We shall not accept provisions in derogation of these terms unless they have been confirmed by the Operator of this Site in writing. By using this website you explicitly signify your agreement to these Terms of Use and without requiring further explanation.

2. Content/Offers, Disclaimer
WtERT provides own and third-party information and knowledge products. Any product proceeding from a partner company is labelled accordingly. In the event of loss or damages, incurred because you relied on information or content, which you received whilst using WtERT, the Operator shall only be liable, if the damage was caused intentionally or with gross negligence by any legal representative or vicarious agent of WtERT or if, due to slight negligence, an obligation is violated that is essential to the contract (contractual obligation). For information offers and knowledge products of partner companies and private persons (e.g. in discussion forums), WtERT provides solely the technical medium. Such information as provided by third parties is information pertaining to the respective originators, authors or disseminators and does not pertain to WtERT. WtERT shall therefore and under no circumstances be liable for the accuracy or reliability of this content, information or offer. In particular, WtERT shall not be liable for any losses or damages incurred to the user who has relied on such information. Contributions, which could damage third parties or which contain information purely for advertising purposes shall be deleted by the webmaster. Any infringement of criminal or competitive law shall be prosecuted immediately. The Operator dissociates himself explicitly from such contributions. The insertion of hyperlinks in our offer is merely to provide access pursuant to Article 3, paragraph 3 of the German Tele-Services Act (TDG). We are not to any extent responsible for the content of linked websites.

3. Proprietary Rights, Use of Content
Proprietary, copyrights and other rights of third parties accessed via WtERT remain wholly pertinent to the holder of these rights and are protected accordingly. Unless stated otherwise in an individual agreement, you are granted to make some limited copies of portions of the Site Content provided that these copies are solely for your personal use and that you keep all copyright or other proprietary notices intact. The distribution in any form of the content and data obtained from the WtERT Site and uploading Site Content on any third-party website is strictly prohibited. It is strictly prohibited to use the WtERT databases for commercial purposes. Any violation thereof shall be legally prosecuted. An online subscription entitles you to the use of the database exclusively during the agreed period, and extends to you individually and to one computer. For use by more than one user or on more than one computer, there are subscription packages for a pre-determined maximum number of users and computers. There are special conditions and offers for companies. In closed user groups, each user receives a personal user name and password for his workplace with which to access the Site. The user agrees to maintain this information as confidential and not to pass it on to third parties. The user shall change this login information should it for any reason have become known to third parties. Passing on database content to third parties, even in part, is strictly prohibited.

4. Agreement on Goods and Services
Goods of our content partners are delivered upon purchase to the postal address provided to us. The shipping costs are calculated separately and at the customary rates. The place of performance is the publisher’s distributing warehouse. As a rule you carry the costs for delivery and as the case may be for additional taxes or customs duties. In as far as goods or services of third parties are offered on the WtERT Site, any agreement made is exclusively between you and the said third-party provider. Any claims are to be directed to the aforementioned third party. All offers are subject to the respective pricelist and delivery conditions of the provider valid at the time of purchase.

5. Advice of Withdrawal

(1) Right of withdrawal As a Customer, you are entitled to revoke your contractual statement in writing (e.g. letter, fax, and email) within 14 days without stating reasons, or, if you have already received the goods, upon sending them back within the time period stated above. The deadline begins no sooner than the receipt of the written advice about the right of withdrawal but not before the receipt of the goods by the Customer (with partial deliveries of the same goods not before the receipt of the first part of the delivery) and not before fulfilling our information duties pursuant to Article 312c, paragraph 2 of the German Civil Code (BGB) in connection with Article 1, paragraph 1, 2 and 4 BGB InfoV as well as our obligations under Article 312e paragraph 1 clause 1 BGB in connection with Article 3 BGB InfoV. In order to not exceed the withdrawal period, the revocation shall be posted in due time.

(3) Consequences of Withdrawal
In the case of an effective withdrawal, mutually received goods and services and as the case may be emoluments (e.g. interest) must be returned. Should the User be unable to return the goods/services completely or only in part or only in a deteriorated form, he/she must pay compensation. This does not apply in the case of goods, if the deterioration of the goods is exclusively attributable to the inspection that would have been possible in a retail shop. No indemnification is due, if the deterioration is such as stated in these Terms of Use. Packable goods are to be returned at our risk. You bear the costs of returning the goods, if the delivered goods are the ones ordered and if the order value does not exceed €40.00 or if the value exceeds this amount and you have at the time of withdrawal not yet made a payment or a partial payment pursuant to this agreement. In all other cases, the goods can be returned free of charge. Non-packable items are collected from the customer. Obligations for refund of payments are to be fulfilled within 30 days. This period begins for you with the communication of withdrawal or the return shipment of goods, for us with the arrival of said goods.

6. Terms of Use – Posts and Forums
By using the dialogue facilities (e.g. discussion forums) on WtERT you agree to restrict yourself to exchanging opinions on a professional level, to refrain from advertising and to respect the interests of others. Any violation of these terms can lead to your contributions being removed and your membership barred.

7. Commitment when using your own Expert Site
You guarantee that you own all required rights to photos or text you post on the Site, or that you have the author’s written consent to post and publish this copyrighted content on the http://www.wtert.eu/ website. In addition, the user guarantees upon posting a photo or text on the Site that the posted content does not violate applicable laws, is not contra bonos mores or does not violate the rights or third parties (name, trademark, copyright, data protection rights, etc.) In particular it is prohibited either directly or indirectly or by linking to other websites, to distribute contents of a pornographic nature, which glorify violence or incite to racial or ethnic hatred, which promote criminal activities or provide instructions for this purpose or which infringe upon the political or religious beliefs of others. Should a claim be raised against the Operator for infringement of the law, (violation of copyright, of general rights of personality or other infringement of rights), the User indemnifies the Operator from all claims of third parties.

8. Access Authorisation
The Operator reserves the right to refuse allocation of user names and passwords or to cancel login data within seven days without giving any reason. The right to terminate the agreement without notice for cause, in particular, however, if a) incorrect data is supplied on registering b) our Services are misused in any way c) our Services are damaged or their functionality impaired d) the General Terms of Use are breached in any way remains unaffected by this. We explicitly reserve the right to put forward claims for compensation, should the occasion arise.

9. Site Availability
There is no entitlement to constant, uninterrupted availability of our Sites. The Operator does not accept any liability for the temporary unavailability of the Sites due to maintenance work or technical problems.

10. Data Protection
Privacy Policy
We respect the privacy of our Users and commit ourselves to handling the personal data of our Customers with utmost secrecy. We collect, handle and use your data for the sole purpose of processing orders and maintaining our current customer relationships. These data include name, address, industry, position and function. Other contractors receive your data only if it is necessary in order for us to provide our services to you. We only furnish other companies with your data after having received your consent and as a rule only when you have requested specific information. We only use temporary cookies and only to check the status of your shopping basket. For this purpose, the cookie is temporarily placed in your Random Access Memory. IP addresses or personal user profiles are not stored. We are committed to treat our customers’ data confidentially and demand the same from our cooperation partners. Any offer you have accepted at any time you may withdraw at any time.

A note on Google Analytics
This Website uses Google Analytics, a web-based monitoring service of Google Inc. (Google). Google Analytics uses so called cookies, text files, which are saved on your computer to analyse your interaction with the Website. The information generated by the cookie (including your IP address) is transferred to a Google server in the USA and stored there. Google subsequently uses this information to evaluate your interaction with the Site, to compile reports on website activities for the website hosts and to provide other services in connection to website and internet usage. Google may also provide this information to third-parties, if it is required by law, or should third-parties be processing this information for Google. In no case shall Google associate your IP address with other data at Google Inc. 11. Other Provisions
When this agreement stipulates the written form, this includes messages by email, fax. The laws of the Federal Republic of Germany govern the legal relationship of the User and the Website WtERT.

12. Severability Clause
If and to the extent that any provision of this Agreement or any future provision of it shall be deemed void or infeasible or lose its validity or feasibility, this shall not affect the validity of the other provisions of this Agreement. The invalid, infeasible, or incomplete provision or provisions shall be replaced with appropriate and currently valid legal provisions. The same shall apply, if the General Terms of Use contain omissions.

Public and Communication

Priciples concerning the public
When we are presenting the professional articles of our content partners, we try to refer to the authors irrespective of the actual copyright. Regarding this as a common interest, we also check and update the autor data we receive from our content partners and change them, if we obtain newer data.
In that we see a very high advantage for our users as well as for the authors themselves, because it is just this data- and information build-up that helps us developing our WtERT expert-database.

Authors can disagree with this principle by sending a mail to postmaster@wtert.eu and will then be removed from the expert-search-function. However they will stay in the database insofar they are listed as autors of a content partner. Possibilities to contact them will be disabled.

Communication inside the community

We regard it as common interest of the WtERT Community to provide users with the possibility to contact authors and experts respectively. Communication will take place on the personal pages of the author on the WtERT plattform itself to ensure not to pass on any e-mail-adresses. If someone contacts an autor or expert, the recipient will receive a standarsized message "Post im Profil". After login the author/expert can handle this message on his personal page. In this way experts from science and experience that are very busy can delegate this process without having to give employees an access to the personal e-mail-account.

The e-mail-adress will be used for this message. It will as well be used to send newsletters or auhor notification (concerning important changes) and author documents (concerning new articles). All of these services can be controlled, ordered, cancelled or countermanded by the author at any time. For a start this will be possible through sending a demand to the operating company (send an e-mail to postmaster@wtert.eu).

In the medium term authors/experts will be able to choose the depth and the amount of communication themselves.
